User Agreement Document

This is an agreement between you and MIHOGO, along with other affiliated companies ("MIHOGO" or "we"). Before using MIHOGO devices, please read the terms of use for these MIHOGO devices, as well as the rules, policies, and terms provided on the MIHOGO.com website, on MIHOGO devices, or through the MIHOGO devices or their accompanying applications (collectively referred to as this "Agreement"). Using MIHOGO devices means that you agree to be bound by the terms of this agreement. If you do not accept these terms, you can stop using MIHOGO devices and return the device for a refund according to the applicable return policy.

The terms of use for MIHOGO devices are as follows:

"MIHOGO devices" refer to various devices provided by MIHOGO Company, including but not limited to [MIHOGO RX MIHOGO LX MIHOGO NX], as well as any MIHOGO accessories or applications provided for these devices under any circumstances. "Software" refers to all software we provide for you to use on MIHOGO devices, but does not include third-party digital content.

a. Learning for Beginners: Your MIHOGO device may serve as a transportation or recreational tool, and you will need to master driving skills through learning and practice. We or our affiliates are not responsible for any injury or damage caused by lack of experience or failure to follow the instructions in the product manual or "User Manual" or "New User Tutorial". You should be fully responsible for safe driving, comply with all local laws and traffic rules, and make judgments on driving and route selection.

b. Backup and Restore: Your MIHOGO device may have the ability to back up some data on the device to the cloud, including but not limited to account settings, notes, wireless configurations, history, communication information, etc. After backup, you can restore this data to your MIHOGO device.

c. Discovery Services: Some applications on your MIHOGO device allow you to discover nearby users or activities. You can use these features to access the online store or community and see your driving ranking in the current city.

d. The use of software. Unless otherwise specified in this agreement, you can only use these software on MIHOGO devices. For additional terms applicable to the software, please refer to the legal or similar provisions in the accompanying application of MIHOGO devices or user manuals.

a. Internet and Wireless Connections: Some features of your MIHOGO device may require an internet connection or data from third-party providers to function properly. In this case, your internet connection or data usage will depend on the fees, restrictions, terms, and limitations set by your provider.

b.Availability: Some services may be unavailable, vary (depending on the device model and location), offered for a limited time, or require a separate subscription. We are not responsible for any part of the MIHOGO device's services being unavailable or other features due to lack of wireless data services.

a. Received information. The software will provide us with interactive information about your use of MIHOGO devices and related services. This information may be used for cloud processing to enhance your service experience and improve our products and services. This information may be stored on servers outside of your region. We will process the information received in accordance with our privacy policy.

b. Correction. We may decide to modify and update any terms of this agreement at our own discretion, and publish the modified terms on the MIHOGO.cn website. If you continue to use the MIHOGO device after the effective date of the revised agreement, it indicates that you have accepted the new terms.

c. Termination. If you do not comply with the terms of use or our policies (including community rules) when publishing or using any content or information in any way, or under any legal or policy requirements or provisions, we have the right to delete such content or information. We have the right to immediately refuse or terminate some or all of the services we provide to you (including terminating or restricting your access to the account) in the following circumstances:

• (a) Protecting our community or services;
• (b) Your actions pose legal risks or violate legal, regulatory, or policy requirements;
• (c) You have violated these Terms of Use or our policies (including community rules);
• (d) You have infringed upon the intellectual property or other legitimate rights and interests of others;
• (e) Legal provisions or other legal requirements.

If we take measures to restrict or terminate the use of your account, we will notify you in accordance with these Terms of Use and our privacy policy. In the event of service termination, you will not receive any refund of fees. MIHOGO's failure to insist or compel you to strictly comply with this agreement does not constitute a waiver of any such right.

d. Dispute Resolution: This agreement is governed by the laws of the People's Republic of China and interpreted according to Chinese law. Any disputes arising from or related to this agreement shall be submitted to the China International Economic and Trade Arbitration Commission for arbitration in Beijing, in accordance with the arbitration rules effective at the time of applying for arbitration.By signing this agreement or using MIHOGO devices or services, you are deemed to have agreed to these terms.

e. Disclaimer and Exemption Clause: Information and materials related to MIHOGO Company in our software, website, or user manual may contain inaccuracies and typographical errors. We do not guarantee the accuracy, completeness, or validity of such information and materials, and we reserve the right to correct any errors or omissions on our own. We may make any other changes to the materials, products, programs, services, or prices (if any) described in the software, website, or user manual at any time without prior notice. The information and materials in our software, website, or user manual are provided on an "as is" basis and we do not provide any form of warranty, whether expressed or implied, including but not limited to warranties of merchantability, non infringement, or suitability for any specific purpose. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Under no circumstances shall we be liable for any indirect, consequential, or punitive damages arising from the use or inability to use this software, including but not limited to loss of profit, loss of business, or loss of goodwill.
